The DUI Process: From Arrest to Conviction/Acquittal

The process of a DUI case in Alabama can be complex and varies from case to case. However, a typical progression includes the following stages:

Arrest: A DUI case begins with the arrest of the individual, which usually occurs after a traffic stop where the officer has reason to believe the driver is impaired.

Booking and Bail: After the arrest, the individual is booked at a police station and may be held in custody. Bail may be set, allowing the individual to be released until their court appearance.

Arraignment: The first court appearance is the arraignment, where the charges are formally presented, and the defendant enters a plea of guilty, not guilty, or no contest.

Pre-Trial Motions: Prior to the trial, various motions may be filed, such as motions to suppress evidence, which can significantly impact the course of the case.

Trial: If the case goes to trial, the prosecution must prove beyond a reasonable doubt that the defendant was driving under the influence. The defense has the opportunity to challenge the prosecution’s evidence and present its own case.

Sentencing: If the defendant is found guilty, the judge will determine the sentence based on the specifics of the case and the defendant’s criminal history. If acquitted, the defendant is released from the charges.

Post-Trial: Following conviction and sentencing, the defendant may have options for appeal or may need to comply with the terms of the sentence, which could include jail time, fines, community service, and DUI education programs.

Throughout this process, having an experienced attorney like Henry Lagman can be crucial. An attorney can guide the defendant through each step, provide legal advice, negotiate plea deals, and represent the defendant in court.
